Procedure for enforcing the mediation agreement regarding child support, custody, and visitation rights in case of non-compliance.

This research focuses on studying the procedure for executing mediation agreements in matters of child support, custody, and visitation in cases of non-compliance. Its objective is to propose a reform to article 363, section 3 of the General Organic Code of Procedures (COGEP) to guarantee the immediate and effective execution of mediation agreements in these matters, with the aim of highlighting the binding nature of mediation as a means of ensuring the effectiveness and guarantee of the rights of children and adolescents, in accordance with the international obligations assumed by the Ecuadorian State. The development includes a study of the concept of mediation, the principle of the best interests of the child, executable titles, and current legal regulations. Likewise, an analysis of how these disciplines are processed judicially between 2016 and 2022 is conducted. This is carried out through a mixed research methodology applying methods such as exegetical-legal, analytical-synthetic, and hermeneutic, and the use of instruments such as interviews and surveys, which reveal the reality and existing need in the country to reform the COGEP to ensure the immediate execution of mediation agreements issued in these cases. The study concludes with a proposal for reform aimed at ensuring full protection of the rights of children and adolescents and the principle of the best interests in the aforementioned matters.
