Procedural advantages in labor judgments against the state

The purpose of this investigation was to analyze the procedural advantages of the Republic of Venezuela in labor lawsuits in which it is a defendant, in the light of effective judicial protection, interpreted from the perspective of guaranteeing the rights of workers and from the approach of Procedural Labor Law. As a legal basis, the Constitution of the Bolivarian Republic of Venezuela, the Organic Procedural Law of Labor, the Organic Law of Labor, Workers and Workers. Among others, were observed. The study was legal, documentary, analytical and descriptive. In conclusion, it was found that the prerogative referring to administrative prejudice is not applicable, based on an interpretation made by the Social Appeal Chamber of the Supreme Court of Justice, however the rest of the procedural advantages remain valid and applicable in the process from work. Likewise, it was concluded that the implementation of procedural advantages collated with the principles of equality and speed, as well as with effective judicial protection of workers' rights.
