Non-compliance with lawful orders issued by a competent authority in cases of detention for domestic violence

The research analyzes the crime of non-compliance with lawful orders issued by a competent authority in contexts of domestic violence in Ecuador, based on Article 282 of the Comprehensive Organic Criminal Code and its relationship with protective measures granted to individuals at risk, aiming to identify procedural and criminal shortcomings in the handling of these cases and their impact on the effectiveness of such measures; it examines the concept of lawful orders, their validity and effectiveness within the legal system, emphasizing that orders issued by a competent authority constitute a legally binding duty with criminal relevance, and addresses domestic violence as a legal and social phenomenon that requires effective state responses within both national and international legal frameworks; through a qualitative and descriptive methodology using analytical-synthetic, inductive-deductive, and legal exegetical methods, the findings reveal a high incidence of non-compliance with protective measures alongside a limited criminal response, leading to revictimization, perceptions of impunity, and weakened trust in the justice system, concluding that it is necessary to reinterpret this offense from a human rights perspective, strengthen the design and justification of protective measures, and improve enforcement and sanction mechanisms to ensure real conditions of safety for victims.
