Cybercrimes as a criminal offense within the Ecuadorian criminal legal system

Cybercrime has established itself as a rapidly growing, common activity worldwide, representing one of the most difficult challenges for developing countries. The proliferation of everyday online activities, from entertainment to finance, has provided a breeding ground for cybercrime, demanding attention and an effective legal response. Technology advances faster than legislators' ability to quickly regulate cyber threats. The National Code of Criminal Procedure contains criminal offenses related to cybercrimes; however, analysis suggests that an update is needed to cover the topic more broadly. This scientific article aims to provide a comprehensive doctrinal and empirical study on the evolution of cybercrime in Ecuador. This article uses a descriptive and analytical qualitative approach, examining regulatory gaps and evidentiary difficulties, among other aspects.
