Fundamental guarantees and legal protection: an analysis of human rights in the constitutional framework of Ecuador.

The validity of human rights within Ecuador’s constitutional framework represents a major step forward in consolidating the constitutional State of rights and justice. These rights, seen as inherent to human dignity, serve as the normative foundation that guides state actions, limits public power, and ensures the respect of fundamental freedoms. The 2008 Constitution enshrined human rights at the highest level of legal protection, mandating their direct and immediate application by all authorities. Additionally, the pro persona principle requires legal norms to be interpreted in a way that maximizes rights enjoyment. However, their effectiveness depends on the availability of efficient legal remedies and strong institutional commitment to uphold these rights. Therefore, strengthening the legal framework and judicial enforcement is crucial to ensure the real and practical implementation of human rights in Ecuador.
