Legal capacity of persons with intellectual disabilities: analysis of case law on autonomy, representation, and fundamental rights.

The article examines the evolution of legal capacity for people with intellectual disabilities in contemporary Ecuador, with particular attention to the tension between the traditional model of substituted decision-making and the support model promoted by the Convention on the Rights of Persons with Disabilities. It analyzes Article Twelve of the Convention and its interpretation in General Comment Number One, contrasting them with domestic legislation and recent case law from the Ecuadorian Constitutional Court. Using a comparative approach with Argentina, Colombia, and Mexico, the study identifies normative advances as well as persistent cultural resistances and legal gaps that limit the effective implementation of the support model. The findings reveal a constitutionally protective framework, yet with practical challenges in achieving full legal capacity. The article emphasizes the urgent need for legislative innovations and pedagogical strategies that strengthen the legal autonomy of people with intellectual disabilities and promote the effective application of an inclusive model that respects their rights.
