La pre-comprensión y comprensión del Derecho: una aproximación necesaria

Resumen

Este trabajo trata el método que le otorga al universal concreto la función de la transformación práctica de la realidad frente a las filosofías irracionalistas que le otorgan a lo abstracto o momentos de pre-comprensión, ya sea empírica, intuitiva y de representación inmediata del derecho, el carácter de fin de la teoría. Este método está motivado por la necesidad de no ver la moral y los principios solo como entidades espirituales que por sí mismos constituyen la panacea de todos los problemas del derecho. Lo trascendente es que hay un intento de rebasar ese momento, obsérvese minuciosamente la defensa de la capacidad del método defendido para distinguir el rol de lo abstracto y lo concreto en la comprensión del derecho y se concluirá que el orden moral y sus principios son formas sociales ideales configuradas, no puede ser de otra forma, como resultado de la actividad cotidiana de los individuos, en sus relaciones sociales específicas.

ABSTRACT

This work deals with the method that gives the concrete universal the function of the practical transformation of reality against the irrationalist philosophies that give the abstract or moments of pre-understanding, whether empirical, intuitive and immediate representation of the right, the end character of the theory. This method is motivated by the need not to see morals and principles only as spiritual entities that by themselves constitute the panacea of all the problems of law. The transcendent is that there is an attempt to go beyond that moment, carefully observe the defense of the ability of the defended method to distinguish the role of the abstract and the concrete in the understanding of law and conclude that the moral order and its principles are social forms configured ideals, can not be otherwise, as a result of the daily activity of in their specific social relationships.
